evidence that it relied on any action by plaintiffs with respect to defendant's My.MP3.com service. The court also must reject the defendant's unclean hands defense given MP3.com's failure to come forth with any admissible evidence showing bad faith or misconduct on the part of plaintiffs.
Therefore the Court, for the reasons listed above, have determined that UMG Recordings is entitled to partial summary judgment holding MP3.com have infringed upon UMG's copyrights.
